Restricted Housing Units

If your home is subject to a Restricted Unit Housing Covenant, there are three on-going restrictions to your property.  You are required to notify potential buyers of these restrictions.  If you use a Realtor, please have that Realtor contact the Division of Housing to ensure they understand the restrictions.

  • Size Restriction: The size is limited so that the floor area shall never exceed the amount specified in the covenant for your home.
  • Owner-occupancy requirement: Every party on title must owner-occupy the unit as his or her primary residence. Please contact our office prior to the sale of your property. Before the time when the title is transferred, the new homeowner is required to certify with the city his or her intent to occupy the property as his or her primary residence.   • Rental restriction: After 12 months of ownership, your property may be rented for a period or periods of time not to exceed one year out of seven. Prior to renting your property you must contact our office to notify the Division of Housing of your intent to lease your home.

You are exempt from the rental licensing requirement if you owner occupy your home and house no more than two roomers who are unrelated to you.  Because your home is your primary residence, you may also be exempt from rental licensing for rental periods of 12 months or less.  Contact the Rental Housing Licensing and Inspection Program at 303-441-1880 for more information.

Buy-Out Option: In November 2002, City Council approved an amendment to allow the city manager to release certain housing requirements of the owners of the Restricted Housing units. If you have questions about the buyout option, please contact the Housing Division at 303-441-3157.
