What to Expect in Court

 What is the likely outcome of my case?

The outcome of your case will depend on whether you have had a previous MIP ticket.

First MIP ticket:

  • Likely offered a form of diversion called a Deferred Prosecution
  • Not required to plead guilty
  • Required to pay for and attend alcohol class
  • Pay $50 court fee due on the day of court
  • Once alcohol program is completed, you can petition the court to seal your record

Second MIP ticket:

  • Likely offered a Deferred Judgment and Sentence
  • Required to plead guilty but after nine months your case will be dismised if you complete the conditions of your Deferred Judgment
  • Most cases are required to pay for and attend an alcohol treatment program
  • Pay a $160 court fee due on the day of court
  • Perform 24 hours of community service from a list provided by the court
  • Once your cases is dismissed, you can petition for the court to have your record sealed

Third or more MIP ticket:

  • Not likely to receive a plea bargain offer
  • If you plead guilty, you will be sentenced to pay a fine, community service and complete an alcohol evaulation and whatever treatment recommended. All at your expense.
  • Driver's license will be suspended if you do not attend your assigned alcohol treatment
  • After one year from the date of your guilty plea, you can petition the court to have your record sealed if you have no new charges.

Are MIP tickets from other courts or states counted? 

It is up to the city prosecutor’s office to decide which records to check when looking for prior MIP cases. You will not know until you come to court on your court date what plea bargain offer (Deferred Prosecution, Deferred Judgment, no offer) is being made in your case.
